Lokket, Inc. Billing Policy

By opening an account with Lokket, Inc you agree to abide by all policies of Lokket, Inc.. These policies apply to all users Lokket, Inc. without exception; failure to adhere to the stated policies may result in termination of the account at the discretion of Lokket, Inc. Lokket, Inc. reserves the right to change policies, services, and pricing. Your continued use of an account signifies acceptance of any and all policies and policy changes, and you may cancel if you do not agree with changes in policy, service, or pricing. Lokket, Inc. reserves the right to refuse to provide service to anyone.

Disclaimers

Lokket, Inc. makes no warranties of any kind, whether express or implied, for the service it is providing. Lokket, Inc. will not be held responsible for any damage you suffer from use of an account or service provided by Lokket, Inc. unless otherwise agreed to in writing. This includes- but is not limited to- equipment damage, failure or loss of data resulting from delays, non-deliveries, or service interruptions caused by the company's negligence or your negligence or misuse. Lokket, Inc. cannot be held responsible if long distance or other communications fees are incurred.

Privacy

Lokket, Inc. is committed to preserving the privacy of its customers and protecting their personal data. Lokket does not actively monitor customer use of the Internet, customer email or other customer communications in the course of its regular operations. Lokket is also strongly opposed to the use of third-party information-harvesting strategies and technologies such as unlawful wiretapping.

Information retained by Lokket, Inc.:

Lokket, Inc. keeps information about its customers such as names, addresses, telephone numbers, email addresses and details about Lokket services used by the customer. All such information is considered private. Lokket also keeps logs of limited technical information pertaining to matters such as customer connectivity. These logs are retained on a temporary basis in order to insure high-quality service, and no logs are kept indefinitely. The only circumstances wherein Lokket will disclose any of the above-mentioned information to a third party are:

  • In the course of providing services our customers have specifically requested, Lokket, Inc. may make some of this information available to our affiliates in order to fulfill the requirements of order processing.
  • In the event that we receive a legitimate, legally-mandated request for customer information, Lokket, Inc. will respond only within the narrow scope of that request.
  • Lokket, Inc. will not otherwise disclose any private information about its customers to any other third party.


    2. General Subscriber Information

    Enterprise Customers, please see the specific terms and conditions of your contract.

    Thank you for choosing Lokket, Inc. (henceforth referred to as "Lokket") as your Internet Service Provider.

    By signing up for any Lokket services, you acknowledge that you are eighteen (18) years of age or older, you agree that you have the legal authority to enter into this agreement, and affirm that the information you supply to us is correct and complete.

    Please understand that Lokket relies on the information you supply and that providing incorrect information may result in delays of service, a lock on the account, or termination of your account services.

    Lokket reserves the right to change policies, services, and pricing. Your continued use of a Lokket account signifies acceptance of any and all policies as well as policy or price changes. You may cancel your account if you do not agree with changes in policy, service, or pricing.

    Lokket reserves the right to refuse to provide service to anyone.


    3. Account and Billing Information

    Please help us serve you better by notifying us of any changes to your personal or billing information. To update your contact or billing information call us at 1-858-345-1616. Unfortunately, we are not able to update customer information via email due to security reasons. We will only make changes for the owner-of-record or those with listed administrative access to an account.


    4. Payment/Renewal Options

    4.1 Credit Card Payments

    All Residential and Small Business accounts are required to have an active credit card or linked bank account on file for automatic billing. Your payment will be processed 5 days before your due date.

  • Payment Failure: If for any reason your credit card renewal is unable to be processed, you will be notified via email. A second attempt will be made on your due date. If the payment is declined for any reason, we ask that you please call and verify your credit card information.
  • New Credit Cards or Updated Expirations: If you receive a new credit card number or an updated expiration date please update your details at least 5 days before your next due date to update your credit card information for the next renewal. Or contact us at 1-858-345-1616 during business hours and we will be happy to assist you.
  • Disputes/Charge Backs: Any billing related inquiries should be directed to 1-858-345-1616 between the hours of 9AM and 5PM Monday through Friday. We will need your username, credit card number, and the original post date of the charge in question. If you wish to dispute any charges that Lokket has made to your credit card, please notify us within thirty (30) days of the original posting date of the transaction. If you dispute charges directly with your bank and your dispute results in a credit card charge-back to Lokket, you will be charged a twenty-five-dollar ($25.00) service fee. You will be responsible for any non-disputed charges beyond thirty (30) days.

  • 5. Billing cycle

    Account services are billed monthly. All Lokket services are billed in advance. Payments are credited from the account due date, not from the date the payment is received.

    5.1 Grace Period/Late Fee:

    A grace period of three days from the due date is given for most accounts. After five days without payment, services may be suspended at the discretion of Lokket, Inc.

    5.2 Cancellation and refunds

    Effective 6/15/2020: Your service automatically renews until you cancel. Cancellations will take effect at your next billing date. Your service will remain active until that date and you may continue to use your service until your subscription ends. No refunds will be provided on prepaid services.

    Unfortunately, we are not able to suspend accounts or place accounts "on hold." If you will be unable to use your account for an extended period of time, we advise you to cancel the account and reinstate it at a later date. This includes users whose equipment is down for repair or is otherwise unusable for the purpose of connecting to Lokket. Lokket does not monitor the usage of your service. Absence of activity will not result in termination of your account by Lokket and no refunds will be given based on the absence of activity. If you fail to notify us of your intention to cancel you will be responsible for all fees until the date of account termination regardless of whether you used the service.

    For your protection, cancellation of your account must be done in person, by phone, or by e-mail. Written requests must contain your name, the current date, your reason for cancellation, and the account holder's signature. Only the primary account holder or other verified listed admin can cancel an account.


    6. Hardware

    6.1 Hardware Warranty

    Lokket makes no warranties whatsoever on any products it does not manufacture and passes through any manufacturer warranties issued for the products it represents. Warranty returns are subject to the individual manufacturer's warranty return policy. Warranties vary by manufacturer. Customer agrees to consult the manufacturer of the product purchased regarding their warranty policy prior to contacting Lokket. If the Product purchased is determined to be within the manufacturers' warranty policy Lokket may assist in obtaining warranty service. If Customer has trouble obtaining warranty service from the manufacture contact Lokket for individual manufacture warranty procedures.

    6.2 Hardware Refunds

    Unopened Products: Any unopened Product purchased directly from Lokket may be returned for a refund within 30 days of purchase with a valid proof of purchase.

    Opened Products: Products purchased directly from the Lokket that are opened may be returned for a refund subject to the following conditions.

      a. Items may only be returned within 14 days of purchase.
      b. A 15% restocking fee may be applied.
      c. Products are non-refundable if they are damaged, abused or missing any accessories.

    Defective Products: Defective Products purchased from Lokket may be returned for repair or replacement by submitting a Return Merchandise Authorization (“RMA”) request if they are under warranty.

    In either case of return under this Section, you are responsible for all shipping charges of returned items and cost to insure the shipment or accept the risk of loss or damage during shipment.

    EXCEPT FOR ANY EXPRESS WARRANTIES PROVIDED HEREIN, LOKKET, ITS AFFILIATES, AND ITS AND THEIR THIRD PARTY DATA, SERVICE, SOFTWARE AND HARDWARE PROVIDERS HEREBY DISCLAIM AND MAKE NO OTHER REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, REPRESENTATIONS, GUARANTEES, OR WARRANTIES OF MERCHANTABILITY, ACCURACY, QUALITY OF SERVICE OR RESULTS, AVAILABILITY, SATISFACTORY QUALITY, LACK OF VIRUSES, QUIET ENJOYMENT, FITNESS FOR A PARTICULAR PURPOSE AND USE, NON-INFRINGEMENT AND ANY WARRANTIES ARISING FROM ANY COURSE OF DEALING, USAGE OR TRADE PRACTICE IN CONNECTION WITH SUCH PRODUCTS AND SERVICES. CUSTOMER ACKNOWLEDGES THAT NEITHER LOKKET NOR ITS THIRD PARTY PROVIDERS CONTROL CUSTOMER’S EQUIPMENT OR THE TRANSFER OF DATA OVER COMMUNICATIONS FACILITIES, INCLUDING THE INTERNET, AND THAT THE PRODUCTS AND SERVICES MAY BE SUBJECT TO LIMITATIONS, INTERRUPTIONS, DELAYS, CANCELLATIONS AND OTHER PROBLEMS INHERENT IN THE USE OF COMMUNICATIONS FACILITIES. LOKKET , ITS AFFILIATES AND ITS AND THEIR THIRD PARTY PROVIDERS ARE NOT RESPONSIBLE FOR ANY INTERRUPTIONS, DELAYS, CANCELLATIONS, DELIVERY FAILURES, DATA LOSS, LOSS OF PROFITS, LOSS OF USE, CONTENT CORRUPTION, PACKET LOSS, OR OTHER DAMAGE RESULTING FROM ANY OF THE FOREGOING INCLUDING ACTS OF GOD. In addition, LOKKET does not warrant that the operation of the Products will be error-free or that operation will be uninterrupted. In no event shall LOKKET be responsible for damages or claims of any nature or description relating to system performance, including coverage, customer’s selection of products (including the Products) for customer’s application and/or failure of products (including the Products) to meet government or regulatory requirements. No LOKKET employee, agent, or reseller can make any verbal or written modification, extension, or addition to this warranty.

    Limitation of Liability

    EXCEPT TO THE EXTENT PROHIBITED BY LOCAL LAW, IN NO EVENT WILL LOKKET OR ITS SUBSIDIARIES, AFFILIATES OR SUPPLIERS BE LIABLE FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES (INCLUDING LOST PROFIT, LOST DATA, LOSS OF USE, OR DOWNTIME COSTS), ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF THE PRODUCT, WHETHER BASED IN WARRANTY, CONTRACT, TORT OR OTHER LEGAL THEORY, AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ALL DISPUTES WITH LOKKET ARISING IN ANY WAY FROM THIS LIMITED WARRANTY OR FROM THE SALE, CONDITION OR PERFORMANCE OF THE PRODUCTS SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION AS SET FORTH IN THE APPLICABLE PRODUCT QUICK START GUIDE AND, IF APPLICABLE, THE APPLICABLE PRODUCT USER GUIDE, AND NOT BY A COURT OR JURY.
